  2. Menghadap siapa saja yang dianggap perlu dan berguna serta melakukan segala tindakan yang diperlukan demi tercapainya maksud tersebut diatas tanpa ada satu tindakapnpun yang dikecualikan.

Convention on the Rights of the Child

Approved by the General Assembly of the United Nations
on November 20, 1989
Preamble
The States Parties to the present Convention
Taking into account that according to the principles expressed in the Charter of the United Nations recognition of the inherent dignity and equal rights and an integral part of all members of the human race , is the foundation of freedom , justice and peace in the world.

Given that the nations of the United Nations have expressed once again their belief in the charter of basic rights of human beings , the dignity and respect the human person , and have determined to promote social progress and better standards of life in larger freedom broad.

Admitted that the United Nations , the Universal Declaration of Human Rights and the International Covenants on Human Rights , proclaimed and agreed that everyone is entitled to all the rights and freedoms set forth therein , without distinction of any kind such as race , color , sex , language , religion, political , or other opinion , national or social origin , property or other status.

Considering that the Universal Declaration of Human Rights , the United Nations has stated that the children are entitled to parenting and special assistance.

Convinced that the family , as the fundamental group of society and nature 's environment for the growth and well-being of all its members and particularly children , should be given the necessary protection and assistance so that it can fully assume its responsibilities within the community.

Admitted that the child , for the full development of his personality fully and harmoniously , should grow up in a family environment in an atmosphere of happiness , love and understanding.

Considering that the child should be prepared to live an individual life and society , and raised the spirit of the ideals set forth in the Charter of the United Nations , and especially in the spirit of peace, dignity , tolerance , freedom , equality and solidarity.

Given that the need to give special care to the child has been stated in the Geneva Declaration of the Rights of the Child in 1924 and the Declaration of the Rights of the Child which was approved by the General Assembly on 20 November 1959 and recognized in the Universal Declaration of Human Rights , in the International Covenant on Civil and Political rights ( especially in chapter 23 and chapter 24 ) , the International Covenant on Economic, Social and Cultural Rights ( especially article 10 ) and in the statutes and relevant instruments of specialized agencies and international organizations concerned with the welfare of children.

Given that as indicated in the Declaration of the Rights of the Child , " the child , by reason of his physical and mental immaturity , needs special safeguards and care , including appropriate legal protection , before as well as after birth " ,

Recalling the provisions of the Declaration on Principles of Social and Legal relating to the Protection and Welfare of Children , with Special Reference to Foster Placement and Adoption Nationally and Internationally; Standard Minimum Rules of the United Nations , for the Administration of Juvenile Justice ( Beijing Rules ) ; and the Declaration on the Protection of Women and Children in Emergency and Armed Conflict ,

Admitted the importance of international cooperation for improving the livelihood of children in every country , especially in developing countries ,
Agreed as follows :

Part I
Article 1

For the purposes of the present Convention , a child means every human being below the age of eighteen years unless under the law applicable to the child , maturity is attained earlier .
Article 2
  1. States Parties shall respect and ensure the rights set forth in the present Convention to each child within their jurisdiction without discrimination of any kind , regardless of race, color , sex , language , religion , political opinion or other opinion , nationality , ethnic or social origin , property, disability , birth or other status of the child or the child's parent or legal guardian of the child .
  2. States Parties shall take all appropriate measures to ensure that children are protected from all forms of discrimination or punishment on the basis of the status , activities , expressed opinions, or beliefs of the child's parents , legal guardians, or family members .

Article 3
  1. In all actions concerning children, whether undertaken by institutions or private social welfare institutions , courts of law , administrative authorities or legislative bodies, the best interests of the child shall be a primary consideration .
  2. States Parties undertake to ensure the protection and care of children as needed for well-being , taking into account the rights and duties of parents , legal guardians or other persons legally responsible for him , and for this purpose , should take all legislative and administrative measures are appropriate .
  3. States Parties shall ensure that the institutions , services and facilities responsible for the care or protection of children shall conform with the standards established by competent authorities , particularly in the areas of safety , health , in the number of and suitability of staff , and also their oversight authorities.

Article 4
States Parties shall undertake all appropriate legislative, administrative , and other appropriate measures for the implementation of the rights recognized in the present Convention . Regarding the rights of economic, social and cultural , the States Parties shall undertake such measures to the maximum extent possible from the sources they are available and where needed, within the framework of international cooperation .

Article 5
States Parties shall respect the responsibilities , rights and duties of parents or, if applicable, the members of the extended family or community as administered by local custom , legal guardians or other persons legally responsible responsible for the child, to provide, in a manner consistent with the evolving capacities of the child , appropriate direction and guidance in the implementation of the child rights recognized in the present Convention .

Article 6
1 . States Parties recognize that every child has the inherent right to life .
2 . States Parties shall ensure to the maximum possible range of resistance and development of children .

Article 7
  1. The Child shall be registered immediately after birth and shall have the right from birth to a name , the right to obtain citizenship , and as far as possible , the right to know and be cared for by their parents .
  2. States Parties shall ensure the implementation of these rights in accordance with their national law and their obligations under international instruments relevant in this field , especially if the child would otherwise be stateless .

Article 8
  1. States Parties undertake to respect the child's right to maintain its identity , including nationality , name and family relations as recognized by law without unlawful interference .
  2. Where a child is illegally deprived of some or all of the elements of her identity, States Parties shall provide appropriate assistance and protection, with a view to speedily re-establishing his identity .


Article 9
  1. States Parties shall ensure that a child shall not be separated from his or her parents against their will , except when competent authorities subject to yudicial review determine, in accordance with applicable law and procedures, that such separation is necessary in the interests of The best child . Such determination may be necessary in a particular case such as one involving abuse or neglect of children by parents , or cases where the parents are living separately and a decision must be made regarding the child 's residence .
  2. In any proceedings in accordance with the provisions of paragraph 1 of this article , all interested parties must be given the opportunity to participate in the proceedings and make their opinions known .
  3. States Parties shall respect the right of the child who is separated from one or both parents to maintain personal relations and direct contact with both parents on a regular basis , unless contrary to the best interests of the child .
  4. Where such separation results from any action initiated by a State Party, such as the detention , imprisonment , exile , deportation or death ( including death from any cause as long as the person is in custody country ) one or both parents of the child , the State Party which concerned at the request must provide to the child or , if appropriate, other family members with basic information about the place being a member or family member that stretch of nothing except giving information that would be detrimental to the welfare of the child. States Parties shall further ensure that the submission of such a request shall of itself entail no adverse consequences for the person ( or people ) are concerned .

Article 10
  1. Accordance with the obligation of States Parties under article 9, paragraph 1 , the filing of a request by a child or her parents to enter or leave a State Party for the purpose of family reunification will be dealt with by States Parties in a positive way , humane and smoothly . States Parties shall further ensure that the submission of such a request shall entail no adverse consequences for the applicants and their family members .
  2. A child where her parents lived in another country is entitled to hold , on a regular basis except in circumstances exceptional , personal relations and direct contact with both parents . Towards that end and in accordance with the obligation of States Parties under article 9, paragraph 2 , States Parties shall respect the rights of the child and his parents to leave any country , including their own country , and to enter their own country . The right to leave any country shall be subject only to such limitations as are prescribed by law and are necessary to protect national security , public order , health , or morals or the rights and freedoms of others and are consistent with the right - other rights recognized in the present Convention .


Article 11
  1. States Parties shall take measures to combat the illicit trafficking of children and non-return of children who are outside the country .
  2. For this purpose, States Parties shall promote the conclusion of bilateral or multilateral agreements or accession to existing agreements .

Article 12
  1. States Parties shall assure to the child who is capable of forming his own opinion , the right to express those opinions freely in all matters affecting the child , the views of the child should be given weight in accordance with the age and maturity of the child .
  2. For this purpose, the child shall in particular be provided the opportunity to be heard in court proceedings and administrative affecting the child , either directly , or through a representative or an appropriate body , in a manner consistent with the procedural rules national law .


Article 13
  1. The Son shall have the right to freedom of expression , this right includes freedom to seek , receive and impart information and ideas of all kinds , regardless of frontiers , either orally , in writing or in print, in the form of art , or through any other media options child .
  2. Implementation of this right may be subject to certain restrictions , but it will only as prescribed by law and necessary :

( a) For respect of the rights or reputations of others ; or
( b ) For the protection of national security or public order , or of public health or morals .

Article 14
  1. States Parties shall respect the right of the child to freedom of thought , conscience and religion .
  2. States Parties shall respect the rights and duties of parents , and when applicable , legal guardians , to provide direction to the child in the exercise of their rights in a manner consistent with the ability of the developing child .
  3. Freedom to express one's religion or belief a person , be subject only to such limitations as are prescribed by law and are necessary to protect public safety , order, health or morals or the rights or fundamental freedoms of others.


Article 15
  1. States Parties recognize the rights of the child to freedom of assemble and freedom of peaceful assembly .
  2. No restrictions may be placed on the implementation of these rights , other than those imposed in accordance with the law and which are necessary in a democratic society , in the interests of national security or public safety , public order , the protection of public health or morals or the protection of the rights and freedoms of others.


Article 16
  1. No child shall be used as the target of intervention arbitrary or unauthorized access to personal privacy , family , home or correspondence , or of unlawful attacks on his honor and reputation .
  2. Children are entitled to the protection of the law against such interference or attack .


Article 17

States Parties recognize the important function performed by the mass media and shall ensure that the child has access to information and material from a diversity of sources of national and international ; primarily aimed at the improvement of social welfare , spiritual and kesusilaannya and physical and mental health . For this purpose, States Parties shall :
( a) Encourage the mass media to disseminate information and material of social and cultural benefit to the child and in accordance with the meaning of article 29 ;
( b ) Encourage international co-operation in the production , exchange and dissemination of information and material from a diversity of cultural , national sources and international ;
( c ) Encourage the production and dissemination of children's books ;
( d ) Encourage the mass media to have particular regard to the linguistic needs of the child who belongs to a minority group or who is indigenous ;
( e ) Encourage the development of appropriate guidelines for the protection of the child from information and material injurious to his welfare in mind the provisions of articles 13 and 18 .

Article 18
  1. States Parties shall use their best efforts to ensure recognition of the principle that both parents have common responsibilities for mature jawwab and child development . Parents or , later however , legal guardians , have the primary responsibility for the maturation and development of children . Best interests of the child will be their basic concern .
  2. For the purpose of guaranteeing and promoting the rights set forth in the present Convention, States Parties shall render appropriate assistance to parents and legal guardians in the performance of their child-rearing responsibilities and shall ensure the development of institutions , facilities and services for the care of children .
  3. States Parties shall take all appropriate measures to ensure that children of working parents have the right to benefit from services and child care facilities , for which they are eligible .


Article 19
  1. States Parties shall take all necessary legislative, administrative , social and educational measures to protect the child from all forms of physical or mental violence , injury or abuse , neglect or negligent treatment , maltreatment or exploitation , including sexual abuse dive in the care of ( the ) parent , legal guardian or any other person who has the care of the child .
  2. These protective measures , as appropriate, should include effective procedures for the preparation of social programs to provide necessary support for those who have the care of children , and also for other forms of prevention and for identification , reporting , referral, investigation , treatment and follow-up events  child abuse described before, and , as appropriate , for judicial involvement .


Article 20
  1. A child temporarily or remain deprived of his family environment , or which is best for its own sake is not allowed to remain in that environment , shall be entitled to special protection and assistance provided by the State .
  2. States Parties in accordance with their national laws ensure alternative care for such a child .
  3. Such care could include , inter alia , the placement of the child's parents , kafalah of Islamic law , adoption or if necessary placement in suitable institutions for the care of children . When considering resolutions has , then it should be given proper attention on a continuous desire in a child's education and the ethnic , religious , cultural and linguistic background of the child .

Article 21

States Parties that recognize and / or permit the system of adoption shall ensure that the best interests of the child shall be the paramount consideration and they shall :
( a) Ensure that the adoption of a child is authorized only by competent authorities who determine , in accordance with the laws and procedures applicable and based on all the information that is pertinent and reliable , that the adoption is permissible in view of the child's status concerning parents , relatives relatives and legal guardians and that, if required , the persons concerned have given their consent to the adoption by counseling as may be necessary ;
( b ) Recognize that inter-country adoption may be considered as an alternative means of child care , if the child can not be placed in a foster or an adoptive family or in any suitable manner be cared for in the child's country of origin ;
( c ) Ensure that the child concerned by inter-country adoption and protection standards commensurate with the protection and standards that exist in the case of national adoption ;
( d ) Take all appropriate measures to ensure that , in inter - country adoption , the placement does not result in improper financial gain for those involved in it ;
( e ) Promote, where appropriate , the objectives of this chapter by making arrangements or agreements, bilateral or multilateral , and endeavor, within this framework kerrja , ensure that the placement of the child in another country is carried by parra authorities or organs authorized .

Article 22
  1. States Parties shall take appropriate measures to ensure that a child who is seeking refugee status or who is considered a refugee in accordance with the laws and procedures applicable international or domestic , whether unaccompanied or accompanied by his parents or by any other person , receive appropriate protection and humanitarian assistance in the enjoyment of applicable rights set forth in the present Convention and in the instruments of human rights or international humanitarian others , in which the said States are Parties .
  2. For this purpose, States Parties shall provide , as they consider appropriate , co-operation in any efforts by the United Nations and intergovernmental organizations other competent organizations or non - governmental , which cooperate with the United Nations to protect and assist such a child and to trace the parents or family members other than a refugee child in order to obtain information necessary for reunification with his family . In cases where no parents or other family members simply can not be found , the child shall be given the same protection as any other child permanently or temporarily deprived of his family environment for any reason , as set forth in this Convention .


Article 23
  1. States Parties recognize that a mentally handicapped child or physical disabilities should enjoy a full and decent life , in conditions that ensure dignity, promote self-confidence and facilitate the child's active participation in the community .
  2. States Parties recognize the right of the disabled child to special care and shall encourage and ensure the extension, subject to available resources , the provision of the eligible child and those responsible for their care , assistance for which application is filed and the appropriate the state of the child and the circumstances of the parents or others caring for the child .
  3. By recognizing the special needs of a disabled child , assistance extended in accordance with paragraph 2 of the present article shall be provided free of charge , whenever possible , taking into account the financial resources of the parents or others who caring for the child , and should be designed to ensure that the disabled child has effective access to and receives education , training , health care services , rehabilitation services , preparation for work and recreation opportunities in a manner conducive to the achievement of the full social integration possible , and the child's individual development , including the development of culture and soul .
  4. States Parties shall promote, in the spirit of international cooperation , the exchange of appropriate information in the field of preventive health care and of medical , psychological and functional treatment of disabled children , including dissemination of and access to information concerning methods of rehabilitation , education and vocational services , with the aim of enabling States Parties to improve their capabilities and skills and to widen their experience in these areas . In this regard , particular account shall be taken of the needs of developing countries .

Article 24
1 . States Parties recognize the right of the child to the enjoyment of the highest attainable standard of health may be obtained and to facilities for the treatment of illness and rehabilitation of health . States Parties shall strive to ensure that no child is deprived of his right to aksers to such health care services .
2 . States Parties shall pursue full implementation of this right and, in particular, shall take appropriate measures to :
( a) To diminish infant and child mortality ;
( b ) To ensure the provision of necessary medical assistance and health care to all children with emphasis on primary health care ;
( c ) Fighting disease and malnutrition , including within the framework of primary health care through , inter alia , the application of readily available technology and through the provision of adequate nutritious foods and clean drinking-water , taking into consideration the dangers and risks of environmental pollution ;
( d ) Ensure health care before and after birth is right for mothers ;
( e ) ensure that all segments of society , in particular parents and children, are informed , have access to education and are supported in the use of basic knowledge of child health and nutrition , the benefits of breastfeeding , hygiene and environmental sanitation and the prevention of accidents ;
( f ) To develop preventive health care , guidance for parents and family planning education and services .
3 . States Parties shall take all effective and appropriate measures with a view to abolishing traditional practices prejudicial to the health of children.
4 . States Parties undertake to promote and encourage international cooperation with the aim of achieving the realization of the rights recognized in the present article fully and progressively . In this regard , particular account shall be taken of the needs of developing countries .

Article 25
States Parties recognize the right of a child who has been placed by the competent authorities for the purposes of care , protection or treatment of his physical health or mental health or periodic review of the treatment provided to the child and all other circumstances relevant to its placement .

Article 26
  1. States Parties shall recognize for every child the right to benefit from social security , including social insurance and shall take the necessary measures to achieve the full realization of this right in accordance with their national law .
  2. The benefits should , where appropriate, be granted , taking into account the sources and circumstances of the child and those responsible for maintaining and caring for the child , as well as any other consideration relevant to an application for benefits made by the child or on behalf of the child .


Article 27
  1. States Parties recognize the right of every child to a standard of living adequate for the rapidly developing physical , mental , spiritual , moral and social development .
  2. Parents or other persons responsible for the child have the primary responsibility to ensure within their abilities and financial capabilities , livelihood necessary for the child's development .
  3. States Parties , in accordance with national circumstances and within their means , shall take appropriate measures to assist parents and others responsible for the child to implement this right and shall provide material assistance and support programs , particularly regarding nutrition , clothing and housing .
  4. States Parties shall take all appropriate measures to ensure the reimbursement for the child from the parents or other persons having financial responsibility for the child, not only in the State Party but also abroad . Especially , where the person having financial responsibility for the child lives in a State different from the State of the child , States Parties shall promote the accession to international agreements or the conclusion of such agreements , as well as the manufacture of arrangements another right .

Article 28
1 . States Parties recognize the right of the child to education , and with the aim of achieving this right progressively and on the basis of equal opportunity , they shall, in particular :
( a) Make primary education compulsory for all children and terbbuka ;
( b ) Encourage the development of forms of secondary education different , including general and vocational education , making education - the education available and accessible to every child , and take appropriate measures such as the introduction of free education and offering financial assistance if needed ;
( c ) Make higher education accessible to all children by ability with every appropriate means ;
( d ) Make educational and vocational information and guidance available and accessible to all children ;
( e ) Take measures to encourage attendance in school and decrease dropout rates .
2 . States Parties shall take all appropriate measures to ensure that school discipline is administered in a manner consistent with the child's human dignity and in accordance with this Convention .
3 . States Parties shall promote and encourage international cooperation in matters relating to education , especially by contributing to the elimination of ignorance and illiteracy throughout the world and facilitating access to scientific and engineering knowledge and methods of teaching modern . In this regard , special attention should be paid to the needs of developing countries .

Article 29
1 . States Parties agree that the education of the child shall be directed to :
(a ) The development of the child's personality , talents and mental and physical abilities to their fullest potential ;
( b ) The development of respect for human rights and fundamental freedoms and the principles enshrined in the Charter of the United Nations ;
( c ) The development of respect for the child's parents , or her own cultural identity , language and values ​​itself on the national values ​​of the country in which the child is living, the country 's children may originate, and for civilizations different from his or her itself ;
( d ) preparation of the child for responsible life in a free society , in the spirit of understanding, peace , tolerance , equality of sexes , and friendship among all peoples , ethnic, national and religious groups and persons of indigenous origin ;
( e) The development of respect for the natural environment .
2 . No part of this article or article 28 shall be construed so as interfere with the freedom of people and agencies to create and direct educational institutions , subject always to the observance of the principles set forth in paragraph 1 of this Article and the requirements that the education given in such institutions shall meet the minimum standards as may be laid down by the State .

Article 30
In those countries in which ethnic , religious , or linguistic or persons of indigenous origin exist , a child belonging to such a minority or indigenous people can not be denied the right , in community with other members of the group.

Definition of Profession

There has been no agreement on the definition of the profession because there is no standard job / task that how that can be regarded as a profession . Some say that the profession is " one's position even though the profession is not for commercial purposes " . Traditionally there are 4 professions that are already known , namely medicine , law , education , and clergy .

PROFESSIONALISM

Usually understood as a quality that must be possessed by every good executive . The characteristics of professionalism :

  1. Have high skills in a field as well as proficiency in using certain equipment necessary in carrying out the duties concerned with the above areas
  2. Have knowledge and experience as well as intelligence in analyzing a problem and sensitive reading of the situation in a quick and precise and careful in making the best decisions on the basis of sensitivity
  3. Got forward-looking attitude that has the ability to anticipate the development environment that lay before him
  4. Have an independent attitude based on the belief in personal ability and open to listen and respect the opinions of others , but punctilious in is best for themselves and their personal development

Dengan demikian, profesi advokat memiliki peran penting dalam upaya penegakan hukum. Setiap proses hukum, baik pidana, perdata, tata usaha negara, bahkan tata negara, selalu melibatkan profesi advokat yang kedudukannya setara dengan penegak hukum lainnya. Dalam upaya pemberantasan korupsi, terutama praktik mafia peradilan, advokat dapat berperan besar dengan memutus mata rantai praktik mafia peradilan yang terjadi. Peran tersebut dijalankan atau tidak bergantung kepada profesi advokat dan organisasi advokat yang telah dijamin kemerdekaan dan kebebasannya dalam UU Advokat. 

Kemandirian dan kebebasan yang dimiliki oleh profesi advokat, tentu harus diikuti oleh adanya tanggungjawab masing-masing advokat dan Organisasi Profesi yang menaunginya. Ketentuan UU Advokat telah memberikan rambu-rambu agar profesi advokat dijalankan sesuai dengan tujuan untuk menegakkan hukum dan keadilan. Hal yang paling mudah dilihat adalah dari sumpah atau janji advokat yang dilakukan sebelum menjalankan profesinya, yaitu: 

“Demi Allah saya bersumpah/saya berjanji : 
  • bahwa saya akan memegang teguh dan mengamalkan Pancasila sebagai dasar negara dan Undang-Undang Dasar Negara Republik Indonesia; 
  • bahwa saya untuk memperoleh profesi ini, langsung atau tidak langsung dengan menggunakan nama atau cara apapun juga, tidak memberikan atau menjanjikan barang sesuatu kepada siapapun juga; 
  • bahwa saya dalam melaksanakan tugas profesi sebagai pemberi jasa hukum akan bertindak jujur, adil, dan bertanggung jawab berdasarkan hukum dan keadilan; 
  • bahwa saya dalam melaksanakan tugas profesi di dalam atau di luar pengadilan tidak akan memberikan atau menjanjikan sesuatu kepada hakim, pejabat pengadilan atau pejabat lainnya agar memenangkan atau menguntungkan bagi perkara Klien yang sedang atau akan saya tangani;

  • bahwa saya tidak akan menolak untuk melakukan pembelaan atau memberi jasa hukum di dalam suatu perkara yang menurut hemat saya merupakan bagian daripada tanggung jawab profesi saya sebagai seorang Advokat. 
Sumpah tersebut pada hakikatnya adalah janji seorang yang akan menjalani profesi sebagai advokat, kepada Tuhan, diri sendiri, dan masyarakat. Seandainya setiap advokat tidak hanya mengucapkannya sebagai formalitas, tetapi meresapi, meneguhi, dan menjalankannya, tentu kondisi penegakan hukum akan senantiasa meningkat lebih baik. Kekuasaan kehakiman akan benar-benar dapat menegakkan hukum dan keadilan. 

Selain itu, untuk mewujudkan profesi advokat yang berfungsi sebagai penegak hukum dan keadilan juga ditentukan oleh peran Organisasi Advokat. UU Advokat telah memberikan aturan tentang pengawasan, tindakan-tindakan terhadap pelanggaran, dan pemberhentian advokat yang pelaksanaannya dijalankan oleh Organisasi Advokat. Ketentuan Pasal 6 UU Advokat misalnya menentukan bahwa advokat dapat dikenai tindakan dengan alasan: 
  1. mengabaikan atau menelantarkan kepentingan kliennya; 
  2. berbuat atau bertingkah laku yang tidak patut terhadap lawan atau rekan seprofesinya; 
  3. bersikap, bertingkah laku, bertutur kata, atau mengeluarkan pernyataan yang menunjukkan sikap tidak hormat terhadap hukum, peraturan perundang-undangan, atau pengadilan; 
  4. berbuat hal-hal yang bertentangan dengan kewajiban, kehormatan, atau harkat dan martabat profesinya; 
  5. melakukan pelanggaran terhadap peraturan perundangundangan dan atau perbuatan tercela; 
  6. melanggar sumpah/janji Advokat dan/atau kode etik profesi Advokat.

Peran Advokat Dalam Penegakan Hukum

Advokat atau Kuasa Hukum dalam suatu perkara yang ditanganinya mempunyai peran yang sangat penting diantaranya adalah :

A. CITA NEGARA HUKUM DAN SISTEM HUKUM NASIONAL 
Indonesia diidealkan dan dicita-citakan oleh the foun­ding fathers sebagai suatu Negara Hukum (Rechtsstaat/ The Rule of Law). UUD 1945 Pasal 1 ayat (3) menegaskan bahwa “Negara Indonesia adalah Negara Hukum”. Namun, bagaimana cetak biru dan desain makro penjabaran ide negara hukum itu, selama ini belum pernah dirumuskan secara komprehensif. Yang ada hanya pembangunan bidang hukum yang bersifat sektoral. Oleh karena itu, hukum hendaknya dapat dipahami dan dikembangkan sebagai satu kesatuan sistem. Apalagi, negara hendak dipahami sebagai suatu kon­sep hukum, yaitu sebagai Negara Hukum. Dalam hukum se­ba­gai suatu kesatuan sistem terdapat (1) elemen kelembagaan (elemen institusional), (2) elemen kaedah aturan (ele­men instrumental), dan (3) elemen perilaku para

subjek hu­kum yang menyandang hak dan kewajiban yang ditentukan oleh norma aturan itu (elemen subjektif dan kultural). Ketiga elemen sistem hukum itu mencakup (a) kegiatan pembuatan hukum (law making), (b) kegiatan pelaksanaan atau pene­rapan hukum (law administrating), dan (c) kegiatan per­adil­an atas pelanggaran hukum (law adjudicating). Biasanya, kegiatan terakhir lazim juga disebut sebagai kegiatan pene­gakan hukum dalam arti yang sempit (law enforcement) yang di bidang pidana melibatkan peran kepolisian, kejaksa­an, advokat, dan kehakiman atau di bidang perdata melibat­kan peran advokat (pengacara) dan kehakiman. Selain itu, ada pula kegiatan lain yang sering dilupakan orang, yaitu: (d) pemasyarakatan dan pendidikan hukum (law socialization and law education) dalam arti seluas-luasnya yang juga berkaitan dengan (e) pengelolaan informasi hukum (law infor­mation management) sebagai kegiatan penunjang. Ke­lima kegiatan itu biasanya dibagi ke dalam tiga wilayah fung­si kekuasaan negara, yaitu (i) fungsi legislasi dan regulasi, (ii) fungsi eksekutif dan administratif, serta (iii) fungsi yudikatif atau judisial. Organ legislatif adalah lembaga parlemen, organ eksekutif adalah birokrasi pemerintahan, sedangkan organ judikatif adalah birokrasi aparatur penegakan hukum yang mencakup kepolisian, kejaksaan, dan pengadilan. Kese­mua itu harus pula dihubungkan dengan hirarkinya masing-masing mulai dari organ tertinggi sampai terendah, yaitu yang terkait dengan aparatur tingkat pusat, aparatur tingkat provinsi, dan aparatur tingkat kabupaten/kota. 

Dalam keseluruhan elemen, komponen, hirarki dan aspek-aspek yang bersifat sistemik dan saling berkaitan satu sama lain itulah, tercakup pengertian sistem hukum yang harus dikembangkan dalam kerangka Negara Hukum Indo­nesia berdasarkan UUD 1945. Jika dinamika yang berkenaan dengan keseluruhan aspek, elemen, hirarki dan komponen tersebut tidak bekerja secara seimbang dan sinergis, maka hukum sebagai satu kesatuan sistem juga tidak dapat diharapkan tegak sebagaimana mestinya. Sebagai contoh, karena bangsa kita mewarisi tradisi hukum Eropa Konti­nen­tal (civil law), kita cenderung menumpahkan begitu banyak perhatian pada kegiatan pembuatan hukum (law making), tetapi kurang memberikan perhatian yang sama banyaknya terhadap kegiatan penegakan hukum (law enforcing). Bah­kan, kitapun dengan begitu saja menganut paradigma dan doktrin berpikir yang lazim dalam sistem civil law, yaitu berlakunya teori fiktie yang beranggapan bahwa begitu suatu norma hukum ditetapkan, maka pada saat itu setiap orang dianggap tahu hukum. Ketidaktahuan seseorang akan hukum tidak dapat membebaskan orang itu dari tuntutan hukum. Teori ini diberi pembenaran pula oleh prinsip yang juga di­akui universal, yaitu persamaan di hadapan hukum (equality before the law). Orang kaya di Jakarta harus diperlakukan sama oleh hukum dengan orang miskin di daerah terpencil di Mentawai (Sumbar), di Lembah Baliem (Papua), suku Kubu di perbatasan Jambi-Sumatera Selatan, ataupun suku ter­pencil di pulau-pulau kecil di seluruh wilayah Nusantara. 

Teori fiktie di atas memang fiktie sifatnya atau hayalan saja, karena tidak mencerminkan realitas yang sebenarnya. Untuk lingkungan negara-negara maju dan apalagi kecil seperti Belanda dengan tingkat kesejahteraan dan pengeta­huan masyarakatnya yang merata, tentu tidak ada persoalan dengan teori fiktie itu. Dalam masyarakat homogen seperti itu informasi hukum yang tersedia dalam masyarakat bersifat simetris. Tetapi di negara yang demikian besar wilayahnya, begitu banyak pula jumlah penduduknya, serta miskin dan terbelakang pula kondisi kesejahteraan dan pendidikan­nya seperti Indonesia, sudah tentu sistem informasi hukum yang tersedia dalam masyarakat tidak bersifat simetris. Tidaklah adil untuk memaksakan berlaku sesuatu norma hukum ke­pada mereka yang sama sekali tidak mengerti, tidak terlibat, dan tidak terjangkau pengetahuannya tentang norma aturan yang diberlakukan itu kepadanya. Jika dalam norma aturan itu terjadi proses kriminalisasi, sudah tentu orang yang bersangkutan terancam menjadi kriminal tanpa ia sendiri menyadarinya. Oleh karena itu, di samping adanya dan di antara kegiatan pembuatan hukum (law making) dan pe­negakan hukum (law enforcing), diperlukan kegiatan, yaitu pemasya­rakatan hukum (law socialization) yang cenderung diabaikan dan di­anggap tidak penting selama ini. Padahal, inilah kunci tegaknya hukum. Tanpa basis sosial yang me­nyadari hak dan kewajibannya seca­ra hukum, maka hukum apapun yang dibuat tidak akan efektif, tidak akan tegak, dan tidak akan ditaati dengan sungguh-sungguh. 

Oleh karena itu, memahami hukum secara kompre­hen­sif sebagai suatu sistem yang terintegrasi menjadi sangat penting untuk dilakukan. Strategi pembangunan hukum ataupun pembangunan nasional untuk mewujudkan gagasan Negara Hukum (Rechtsstaat atau The Rule of Law) juga tidak boleh terjebak hanya berorientasi membuat hukum saja, ataupun hanya dengan melihat salah satu elemen atau aspek saja dari keseluruhan sistem hukum tersebut di atas. Itulah sebabnya, saya sering mengemukakan penting kita sebagai bangsa menyusun dan merumuskan mengenai apa yang kita maksud dengan konsepsi Negara Hukum Indonesia yang diamanatkan dalam UUD 1945, terutama sekarang telah ditegaskan dalam rumusan ketentuan Pasal 1 ayat (3) UUD 1945. Semua lembaga atau institusi hukum yang ada hen­daklah dilihat sebagai bagian dari keseluruhan sistem hukum yang perlu dikembangkan dalam kerangka Negara Hukum itu. Untuk itu, bangsa Indonesia perlu menyusun suatu blue-print, suatu desain makro tentang Negara Hukum dan Sistem Hukum Indonesia yang hendak kita bangun dan tegakkan di masa depan. 

B. PENEGAKAN HUKUM 
Penegakan Hukum (law enforcement) dalam arti luas mencakup kegiatan untuk melaksanakan dan menerapkan hukum serta melakukan tindakan hukum terhadap setiap pelanggaran atau penyimpangan hukum yang dilakukan oleh subjek hukum, baik melalui prosedur peradilan ataupun me­lalui prosedur arbitrase dan mekanisme penyelesaian seng­keta lainnya (alternative desputes or conflicts resolu­tion). Bah­kan, dalam pengertian yang lebih luas lagi, kegiat­an pe­ne­gakan hukum mencakup pula segala aktifitas yang di­mak­sudkan agar hukum sebagai perangkat kaedah norma­tif yang mengatur dan mengikat para subjek hukum dalam se­gala aspek kehidupan bermasyarakat dan bernegara benar-be­nar ditaati dan sungguh-sungguh dijalankan sebagaimana mesti­nya. Dalam arti sempit, penegakan hukum itu me­nyang­kut kegiatan penindakan terhadap setiap pelanggaran atau pe­nyimpangan terhadap peraturan perundang-undang­an, khu­susnya –yang lebih sempit lagi— melalui proses per­adil­an pidana yang melibatkan peran aparat kepolisian, ke­jak­saan, advokat atau pengacara, dan badan-badan per­adilan. 

Karena itu, dalam arti sempit, aktor-aktor utama yang peranan­nya sangat menonjol dalam proses penegakan hu­kum itu adalah polisi, jaksa, pengacara dan hakim. Para pe­ne­gak hukum ini dapat dilihat pertama-tama sebagai orang atau unsur manusia dengan kualitas, kualifikasi, dan kultur kerjanya masing-masing. Dalam pengertian demikian perso­alan penegakan hukum tergantung aktor, pelaku, peja­bat atau aparat penegak hukum itu sendiri. Kedua, penegak hukum dapat pula dilihat sebagai institusi, badan atau orga­nisasi dengan kualitas birokrasinya sendiri-sendiri. Dalam kaitan itu kita melihat penegakan hukum dari kaca­mata kelembagaan yang pada kenyataannya, belum terinsti­tusio­na­lisasikan secara rasional dan impersonal (institutio­na­lized). Namun, kedua perspektif tersebut perlu dipahami secara komprehensif dengan melihat pula keterkaitannya satu sama lain serta keterkaitannya dengan berbagai faktor dan elemen yang terkait dengan hukum itu sendiri sebagai suatu sistem yang rasional. 

Profesi hukum perlu ditata kembali dan ditingkatkan mutu dan kesejahteraannya. Para profesional hukum itu antara lain meliputi (i) legislator (politisi) (ii) perancang hukum (legal drafter), (iii) advokat, (iv) notaris, (v) pejabat pembuat akta tanah, (vi) polisi, (vii) jaksa, (viii) panitera, (ix) hakim, dan (x) arbiter atau wasit. Untuk meningkatkan kualitas profesionalisme masing-masing profesi tersebut, diperlukan sistem sertifikasi na­sional dan standarisasi, termasuk berkenaan dengan sistem kesejahteraannya. Di samping itu juga diperlukan program pen­didikan dan pelatihan terpadu yang dapat terus menerus membina sikap mental, meningkatkan pengetahuan dan kemampuan profesional aparat hukum tersebut. 

Agenda pengembangan kualitas profesional di kalang­an profesi hukum ini perlu dipisahkan dari program pembi­naan pegawai administrasi di lingkungan lembaga-lembaga hukum tersebut, seperti di pengadilan ataupun di lembaga perwakilan rakyat. Dengan demikian, orientasi peningkatan mutu aparat hukum ini dapat benar-benar dikembangkan secara terarah dan berkesi­nambung­an. Di samping itu, pem­bi­naan kualitas profesional aparat hukum ini dapat pula dila­kukan melalui peningkatan keberdayaan organisasi profesi­nya masing-masing, seperti Ikatan Hakim Indonesia, Persatuan Advokat Indonesia, Ikatan Notaris Indonesia, dan sebagainya. 

Di samping itu, agenda penegakan hukum juga me­mer­lukan kepemimpinan dalam semua tingkatan yang me­menuhi dua syarat. Pertama, kepemimpinan diharapkan dapat menjadi penggerak yang efektif untuk tindakan-tindakan penegakan hukum yang pasti; Kedua, kepemim­pinan tersebut diharapkan dapat menjadi teladan bagi ling­kungan yang dipimpinnya masing-masing mengenai integri­tas kepri­badian orang yang taat aturan. 

Salah satu aspek penting dalam rangka penegakan hukum adalah proses pembudayaan, pemasyarakatan, dan pendidikan hukum (law socialization and law education). Tanpa didukung oleh kesadaran, pengetahuan dan pemahaman oleh para subjek hukum dalam masyarakat, nonsens suatu norma hukum da­pat diharapkan tegak dan ditaati. Karena itu, agenda pem­bu­dayaan, pemasyarakatan dan pendidikan hukum ini perlu dikembangkan tersendiri dalam rangka perwujudan ide nega­­ra hukum di masa depan. Beberapa faktor yang terkait de­ngan soal ini adalah (a) pembangunan dan pengelolaan sis­tem dan infra struktur informasi hukum yang berbasis tek­nologi informasi (information technology); (b) pening­katan Upaya Publikasi, Ko­munikasi dan Sosialisasi Hukum; (c) pengembangan pendidikan dan pelatihan hukum; dan (d) pemasyarakatan citra dan keteladanan-keteladanan di bi­dang hukum. 

Dalam rangka komunikasi hukum, perlu dipikirkan kembali kebutuhan adanya media digital dan elektro­nika, baik radio, televisi maupun jaringan internet dan media lain­nya yang dimiliki dan dikelola khusus oleh pemerintah. Me­nge­nai televisi dan radio dapat dikatakan bahwa televisi dan radio swasta sudah sangat banyak dan karena itu, ke­mung­kinan terjadinya dominasi arus informasi sepihak dari peme­rintah seperti terjadi selama masa Orde Baru tidak mung­kin lagi terjadi. Karena itu, sumber informasi dari masyarakat dan dari pemodal sudah tersedia sangat banyak dan bera­gam. Namun, arus informasi dari pemerintah kepa­da ma­sya­rakat, khususnya berkenaan dengan pendidikan dan pe­ma­sya­­rakatan hukum terasa sangat kurang. Untuk itu, pem­ba­ngunan media khusus tersebut dirasakan sangat di­perlu­kan. Kebijakan semacam ini perlu dipertimbangkan ter­ma­suk me­ngenai kemungkinan memperkuat kedudukan TVRI dan RRI sebagai media pendidikan hukum seperti yang dimaksud.

Akan tetapi, di lingkungan sistem politik yang sudah mapan dan peran-peran profesional telah terbagi sangat ketat, jabatan sebagai anggota parlemen juga dapat berkembang makin lama makin profesional. Politisi lama kelamaan menjadi profesi karena menjadi pilihan hidup profesional dalam masyarakat.

Contoh Surat Putusan Hakim Tindak Pidana

Kita ketahui bahwa Putusan yang diberikan Oleh Hakim kepada Suatu Kasus Perkara tidak boleh ada yang meng intervensi, dan apaila sang Pelaku yang di tindak merasa keberatan maka dia bisa naik banding ke Kasasi, dan apabila juga putusan dari Kasasi tidak memuaskan maka bisa dan berikut ini adalah contoh kecil dari Surat Putusan Hakim dalam kasus Tindak Pidana Pengadilan Negeri :

Menimbang, bahwa berdasarkan surat dakwaan Jaksa Penuntut Umum tanggal 6 Desember 2010 No.Reg.Perk: PDM-306/Rp.9/Ep/11/2010 Terdakwa didakwa sebagai berikut :
 Dakwaan :
Bahwa ia Terdakwa RITMANTO Als.RIT Bin RATA pada hari Kamis tanggal 25 Februari 2010 sekira pukul 11.00 Wita atau setidak-tidaknya pada waktu tertentu dalam bulan Februari tahun 2010, bertempat di Kel. Melulu Kec. Melulu Kab. Konawe atau setidak-tidaknya pada waktu tertentu yang masih termasuk dalam daerah hukum Pengadilan Negeri Unaaha yang berwenang memeriksa dan mengadili perkaranya, telah melantarkan orang lain yakni WIDYA PRANASTUTI (isteri terdakwa) dalam lingkup rumah tangganya sesuai dalam kutipan akta nikah nomor : 11/04/III/2010 tanggal 25 Februari 2010.
Adapun perbuatan terdakwa dilakukan dengan cara sebagai berikut :--------------------------------------------------
      Berawal pada waktu dan tempat sebagaimana tersebut di atas, ketika terdakwa RITMANTO Als.RIT Bin RATA telah menikahi saksi korban WIDYA PRANASTUTI secara sah menurut hukum, akan tetapi sejak pernikahan tersebut terdakwa langsung pergi meninggalkan saksi korban yang merupakan isteri sah dari terdakwa dan tidak memberikan kehidupan, perawatan atau pemeliharaan kepada saksi korbansehingga saksi korban merasa keboratan dan melaporkan perbuatan terdakwa ke Polsek Wawotobi untuk diproses secara hukum.---
      Perbuatan terdakwa sebagaimana diatur dan diancam pidana dalam Pasal 49 huruf a UU RI No.23 Tahun 2004 Tentang Penghapusan Kekerasan Dalam Rumah Tangga.----------
Menimbang, bahwa berdasarkan surat tuntutan Jaksa Penuntut Umum tertanggal 08 Maret 2011 No.Reg.Perkara: 306/RP-9/Ep/11/2010 Terdakwa  telah dituntut sebagai berikut :
1. Menyatakan terdakwa RITMANTO Als.RIT.Bin RATA bersalah menelantarkan orang lain dalam lingkup rumah tangganya sebagaimana diatur dan diancam pidana dalam Pasal 49 a ayat 1 UU No. 23 tahun 2004 tentang Penghapusan Kekerasan Dalam Rumah Tangga ;
2. Menjatuhkan pidana terhadap terdakwa dengan pidana penjara selama 7 (tujuh) bulan dengan perintah terdakwa untuk ditahan di Rutan ;
3. Menyatakan barang bukti berupa :
   - Satu(1) buah surat nikah warna biru dengan nomor : 11/04/III/2010, atas nama WIDYA PRANANTUTI dan RITMANTO Bin RATA.
     Dikembalikan kepada yang berhak
4. Menetapkan agar terdakwa membayar biaya perkara sebesar Rp. 2.000,-(dua ribu rupiah).   
Menimbang, bahwa berdasarkan atas tuntutan tersebut, Pengadilan Negeri Unaaha telah menjatuhkan putusan yang amarnya berbunyi sebagai berikut :
1. Menyatakan Terdakwa RITMANTO.Als. RIT Bin RATA telah terbukti secara sah dan meyakinkan bersalah melakukan tindak pidana “Menelantarkan Orang Lain Dalam Rumah Tangga”;-----------------------------------------------
2. Menjatuhkan pidana terhadap Terdakwa RITMANTOAls. RIT Bin RATA oleh oleh karena itu dengan pidana penjara selama 10 (sepuluh) bulan ;----------------------------
3. Menetapkan barang bukti berupa :
   - Satu(1) buah surat nikah warna biru dengan nomor : 11/04/III/2010, atas nama WIDYA PRANANTUTI dan RITMANTO Bin RATA.
  Dikembalikan kepada yang berhak yaitu RITMANTO atau     WIDYA PRANASTUTI;---------------------------------------
4.Membebankan Terdakwa untuk membayar biaya perkara sebesar    Rp. 2.000,-(dua ribu rupiah) ;--------------------------

Menimbang, bahwa terhadap putusan tersebut Terdakwa telah menyatakan permintaan banding dihadapan Panitera Pengadilan Negeri Unaaha pada tanggal 30 Maret 2011 sebagaimana ternyata dari Akta permintaan banding Nomor : 02/Akta.Pid/2011/PN.Unh dan permintaan banding tersebut telah diberitahukan dengan cara seksama kepada Jaksa Penuntut Umum pada tanggal 7 April 2011 ;------------------
Menimbang, bahwa sehubungan dengan permintaan banding tersebut terdakwa telah mengajukan memori banding tertanggal 9 April 2011 dan memori banding tersebut telah diberitahukan kepada Jaksa penuntut Umum dengan cara seksama pada tanggal 18 April 2011 ;-----------------------

Menimbang, bahwa permintaan akan pemeriksaan dalam tingkat banding banding oleh terdakwa telah diajukan dalam tenggang waktu dan cara serta syarat-syarat yang ditentukan oleh Undang-undang, maka permintaan banding tersebut dapat diterima ;-------------------------------------------------
Menimbang, bahwa setelah Majelis Hakim Pengadilan Tinggi mempelajari dengan seksama berkas perkara dan turunan resmi putusan Pengadilan Negeri Unaaha tanggal 29 Maret 2011 Nomor : 222/Pid.B/2010/PN.Unh serta memori banding dari terdakwa, Majelis Hakim Pengadilan Tinggi Sulawesi Tenggara sependapat dengan pertimbangan Majelis hakim Tingkat Pertama dalam putusannya bahwa terdakwa telah terbukti secara sah dan meyakinkan bersalah melakukan tindak pidana “Menelantarkan Orang Lain Dalam Rumah Tangga”; oleh karena itu pertimbangan Majelis Hakim Tingkat Pertama tersebut diambil alih dan dijadikan sebagai pertimbangan Majelis Hakim Pengadilan Tinggi sendiri dalam memutus perkara ini dalam tingkat banding, kecuali pidana yang telah dijatuhkan oleh Majelis Hakim Tingkat Pertama menurut Majelis Hakim Pengadilan Tinggi masih terlalu ringan sekalipun putusannya telah melebihi tuntutan Jaksa Penuntut Umum yaitu selama 7 (tujuh) bulan dan lebih adil apabila terdakwa dijatuhi pidana seperti yang akan disebut dalam amar putusan dibawah ini ;---------------------------
Menimbang, bahwa mengingat suatu pidana/hukuman yang akan dijatuhkan kepada seorang terdakwa tidak hanya untuk mendidik terdakwa sendiri saja, tetapi juga sebagai contoh bagi masyarakat lainnya agar tidak berbuat serupa dengan terdakwa, sehingga pidana yang akan dijatuhkan kepada terdakwa haruslah setimpal dengan perbuatan yang telah dilakukannya ;---------------------------------------------
Menimbang, bahwa oleh karena itu disamping pertimbangan-pertimbangan yang memberatkan yang telah dipertimbangkan oleh Majelis Hakim Tingkat Pertama, maka menurut Majelis hakim Pengadilan Tinggi hal-hal lain yang memberatkan terdakwa sehingga memperberat hukuman bagi terdakwa adalah sebagai berikut :
1. Bahwa terdakwa ternyata adalah seorang Mahasiswa Fakultas Kejuruan dan Ilmu Pendidikan pada Universitas Lakidende, calon pendidik atau calon Intelektual dimasa depan yang seharusnya tidak berbuat hal yang demikian ;----------------------
2. Maksud terdakwa melaksanakan perkawinan secara sah semata-mata hanya untuk menghindarkan diri dari tahanan Kepolisian atas laporan korban dan keluarganya karena terdakwa telah mengakui menyetubui korban sebanyak empat kali sebelum terjadinya perkawinan tetapi tidak mau mempertanggung jawabkan perbuatannya ;-----------
3. Bahwa dari fakta persidangan ternyata pula terdakwa tidak sayang lagi sama isterinya (korban) ;---------------------------------------
      Menimbang, bahwa berdasarkan pertimbangan-pertimbangan tersebut diatas, Majelis Hakim Pengadilan Tinggi Sulawesi Tenggara menolak alasan-alasan yang dikemukakan oleh terdakwa/Pembanding dalam memori bandingnya pada halaman 3 (tiga) pada pokoknya menyebutkan terdakwa melaksanakan perkawinan karena terpaksa untuk mengikuti dan memenuhi keinginan orang tua saja dan terdakwa belum siap/layak untuk berumah tangga karena terdakwa masih kuliah dan belum memiliki pendapatan dan masih dibiayai oleh orang tua, sehingga terdakwa tidak menghendaki perkawinannya dengan korban;-------------------
Menimbang, bahwa berdasarkan alasan-alasan tersebut diatas berarti terdakwa menyadari akan statusnya, tapi kenapa mau berbuat ternyatatidak mau bertanggung jawab, mahkota seorang wanita, tidak ada harganya bagi terdakwa, seolah-olah barang mainan saja ;---------------------------
Menimbang, bahwa selanjutnya terdakwa dalam memori bandingnya menyebutkan apabila terdakwa dijatuhi pidana penjara selama 10 (sepuluh) bulan, sudah pasti kehidupan korban (saksi Wiya Pranastuti) akan semakin tidak menentu, namun sekiranya dengan pembebasan hukuman dan atau pidana bersyarat pada diri terdakwa maka terdakwa akan kembali berusaha untuk membinahubungan baik dengan isterinya ;-----
Menimbang, bahwa alasan terdakwa tersebut diatas menurut Majelis Hakim Tinggi Pengadilan Tinggi Sulawesi Tenggara hanya sekedar basa basi dan mengada-ada saja, karena telah terungkap dipersidangan terdakwa menyatakan dengan tegas sudah tidak sayang lagi sama isterinya yang baru saja dinikahkan dan langsung pergi hari itu juga dan tidak pernah kembali sampai dengan saat ini, oleh karena itu alasan-alasan memori banding yang diajukan oleh terdakwa haruslah ditolak untuk seluruhnya, karena tidak beralasan hukum ;------------------------------------------
Menimbang, bahwa berdasarkan pertimbangan-pertimbagan tersebut diatas, maka putusan Pengadilan Negeri Unaaha haruslah diperbaiki sekedar mengenai pidana yang dijatuhkan kepada terdakwa, sedangkan putusan selebihnya dapat dikuatkan, yang amarnya sebagaimana tersebut dibawah ini :-
Menimbang, bahwa karena terdakwa dijatuhi pidana maka kepadanya dibebani membayar biaya perkara dalam kedua tingkat peradilan ;----------------------------------------
Mengingat pasal 241/KUHAP dan Undang-Undang No.23 Tahun 2004 tentang Pengahapusan Kekerasan Dalam Rumah Tangga serta ketentuan-ketentuan hukum lain yang bersangkutan dengan perkara ini ;--------------------------
M E N G A D I L I
-  Menerima permintaan banding dari terdakwa ;-------------
-  Memperbaiki putusan Pengadilan Negeri Unaaha tanggal 29 Maret 2011 Nomor 222/Pid.B/2010/PN.Unh sekedar mengenai pidana yang dijatuhkan kepada terdakwa sehingga amarnya berbunyi sebagai berikut ;
- Menghukum terdakwa RITMANTO Als.RIT Bin RATA, oleh karena itu dengan pidana penjara selama 1 (satu) tahun dan 6 (enam) bulan;-------------------------------------
- Menguatkan putusan Pengadilan Negeri Unaaha tersebut untuk selebihnya ;--------------------------------------
- Membebankan biaya perkara kepada terdakwa dalam kedua tingkat peradilan, sedang ditingkat banding sebesar Rp. 5.000,- (lima ribu rupiah) ;----------------------------
Demikian diputuskan dalam rapat  permusyawaratan Majelis Hakim Pengadilan Tinggi Sulawesi Tenggara pada hari Senin, tanggal 23 Mei 2011, oleh kami H. HERMAN NURMAN,SH.,MH  sebagai Ketua Majelis dengan, R.YULIANA RAHADHIE,SH  dan H. DASNIEL, SH masing-masing sebagai Hakim Anggota, berdasarkan Penetapan Wakil Ketua Pengadilan Tinggi sulawesi Tenggara tanggal 4 Mei 2011 Nomor: 29/Pen.Pid/2011/PT.Sultra untuk memeriksa dan mengadili perkara ini dalam tingkat banding dan putusan tersebut diucapkan dalam sidang terbuka untuk umum pada hari Selasa tanggal 24 Mei 2011, oleh Hakim Ketua Majelis tersebut dengan dihadiri Hakim-Hakim Anggota, serta dibantu oleh : MUUMA Panitera Pengganti pada Pengadilan Tinggi tersebut, tanpa dihadiri Jaksa Penuntut Umum dan Terdakwa ;
